North Carolina Home Health CON Applications

The 2012 State Medical Facilities Plan published a need for one Medicare-certified home health agency in Wake County. In response to this need, there were five applications submitted in the April batching cycle as listed below.

  • Hillcrest Home Health of the Triangle
  • Healthkeeperz
  • Maxim Healthcare Services
  • Assisted Care of the Carolinas
  • Oakland Homecare NC

A public hearing will take place on June 11, 2012 at 10 am to discuss the applications, and a final decision is expected by July 29, 2012.

The next batching cycle addresses the published need for two home health agencies  in Mecklenburg County. Applications are due on July 16, 2012.

State Senator Plans to Sponsor CON Bill in Pennsylvania

On Wednesday, Pennsylvania State Senator Jim Ferlo announced his plan to sponsor a new Certificate of Need Law. According to his press release, Senator Ferlo is proposing a “multi-faceted CON process” which would not only require  a state-level review process,  but would also include provisions for health care providers “to invest in community-based primary care centers” and county health departments’ involvement in  “facilitating interactions between members of the community and health care institutions.”

North Carolina CON Committee Releases Interim Report

The North Carolina House Select Committee on the Certificate of Need Process and Related Hospital Issues (“CON Committee”) recently released a report to the General Assembly. The CON Committee’s interim report was issued in compliance with Section 9 of their Committee Charge. The thirteen page document provides a digest of what the CON Committee covered at each of their meetings, and concludes with a page on their findings and recommendations.

The interim report calls for more “transparency and accountability” on the part of the State Health Coordinating Council in developing the State Medical Facilities Plan (SMFP), and acknowledges public concerns that the State Health Coordinating Council may have “possible conflicts of interest.” The CON Committee also recommends that exemptions to need determinations in the SMFP be “greatly limited” to ensure that all applicants are subject to the same requirements. The interim report noted that the CON Committee heard concerns that capital expenditure limits should be adjusted for inflation, and that certain medical equipment should be exempted from CON review. While the report does not issue a recommendation on those issues, it does call for “an expedited process for appellate review in order to shorten the overall Certificate of Need determination process.”

With regard to the Certificate of Public Advantage (COPA) program, the CON Committee calls for “regulatory and judicial oversight” of all COPA agreements “to ensure that the benefits of cooperative agreements outweigh the disadvantages and reduction in competition resulting from such agreements.”

The Committee is required to issue its final report before the 2013 General Assembly convenes.

North Carolina CON Committee’s April Meeting

North Carolina’s House Select Committee on Certificate of Need Process (“CON Committee”) met on April 19th. According to the posted agenda, the CON Committee discussed documentation for their interim report, which is due by May 1st. The CON Committee also discussed proposed legislation that would accompany the interim report. Documents from the meeting other than the agenda were not immediately available, but will be posted here as soon as possible.

South Carolina CON Review Panel’s March 27th Meeting

South Carolina’s CON Review Panel had its second meeting on Tuesday, March 27th. According to the agenda posted on the CON Review Panel website, there were three DHEC staff presentations on CON history, pending changes, and the CON budget. Following the staff presentations, there was a committee discussion of the differences between CON regulation in South Carolina and other states’ CON programs. Before adjourning at noon, the committee opened the floor to thirty minutes of public comment.

NCSL Publishes List of CON Moratoria

The National Conference of State Legislatures (NCSL) covers Certificate of Need as one of its Issues and Research topics. NCSL provides a history of CON programs as well as a listing of what facilities and services are CON regulated in each state. Recently, NCSL added a list of CON Moratoria in each state, along with information on how long each moratorium has been in place.  The table uses 2011 data and provides a useful one-stop digest of moratoria. Materials from North Carolina’s Select Committee on CON March Meeting

North Carolina’s Special Committee on CON Process and Related Hospital Matters (CON Committee) met on March 15th.The CON Committee’s discussion chart provides a brief summary of the CON issues covered during the meeting.

Among the committee’s recommendations for CON issues are increasing the monetary threshold for new project review to $4 million, eliminating the capital expenditure threshold, and increasing the medical equipment threshold to $1.5 million. Other materials posted on the CON Committee’s website include three presentations and the meeting’s agenda.

Letters of Intent Submitted in Kentucky

Monday, February 27th was the deadline for Letters of Intent (LOIs) for projects involving beds for acute care, psychiatric, long term care, chemical dependency, comprehensive physical rehabilitation as well as new clinics, ambulatory care centers and birthing centers. According to data from Kentucky’s Letter of Intent search tool, LOIs were submitted for psychiatric, chemical dependency, nursing beds and limited services clinic projects for the February 27th batching cycle.
